These Terms & Conditions apply to tours, excursions, private tours, transfers and other activities operated by Via di Bella AS (“Via di Bella”, “we”, “us” or “our”).
By making a booking, the customer confirms that they have read, understood and accepted these Terms & Conditions.
1. Booking and Payment
A booking is only confirmed once full payment has been successfully received.
Via di Bella generally accepts confirmed bookings on a prepaid basis only. An enquiry, message, verbal agreement or unpaid reservation does not constitute a confirmed booking unless Via di Bella expressly confirms otherwise in writing.
The customer is responsible for ensuring that all information provided during the booking process is accurate.
The person making the booking is responsible for communicating these Terms & Conditions and all relevant tour information to all participants included in the booking.
2. Prices
The price shown at the time of booking applies to the booking.
Unless otherwise clearly stated, the price displayed during checkout is the price payable for the selected service.
Prices may be changed for future bookings at any time. A later price change does not affect an already confirmed and fully paid booking.
3. Customer Cancellations
Confirmed and paid bookings may be cancelled free of charge up to 24 hours before the scheduled start of the activity.
Cancellations made at least 24 hours before the scheduled start time will receive a full refund.
Cancellations made less than 24 hours before the scheduled start time, as well as no-shows, are non-refundable.
For leisure activities scheduled for a specific date or period, the statutory 14-day right of withdrawal generally does not apply under Norwegian law.
Nothing in these Terms & Conditions limits any rights that cannot legally be excluded under mandatory Norwegian consumer law.
4. Free Rescheduling
Instead of cancelling, the customer may reschedule the booking once free of charge, provided that:
-
the rescheduling request is received at least 24 hours before the scheduled starting time;
-
the new date is for the same tour or activity;
-
the requested new departure has availability; and
-
the booking has not previously been rescheduled.
The original price paid remains unchanged when using the free rescheduling option.
If the price of the selected departure has increased or decreased since the original booking, no additional payment or refund of the price difference will normally be required.
Requests received less than 24 hours before the scheduled starting time are not eligible for free rescheduling.
After the booking has been rescheduled once, it is considered final and remains non-refundable.
5. No-Shows
If a customer does not appear for the tour, the booking is considered a no-show.
No-shows are not entitled to:
-
a refund;
-
a free rescheduling;
-
a voucher; or
-
other compensation.
This also applies when only some members of a booking fail to attend.
6. Punctuality and Late Arrival
Customers are responsible for arriving at the correct meeting point on time.
The departure time stated in the booking confirmation is binding.
Via di Bella may, at its discretion, wait for a late customer for a maximum of five (5) minutes. Customers should not rely on this additional waiting time.
Via di Bella is not required to delay a tour where doing so could negatively affect other guests, the itinerary, safety, transportation arrangements or the operation of the tour.
If a customer misses the departure because of late arrival, no refund or free rescheduling will be provided.
Customers are responsible for allowing sufficient travel time to reach the meeting point.
7. Cruise Ship Cancellations
An exception to the normal non-refundable policy applies when a customer's cruise ship is officially unable to call at Tromsø or the scheduled port call in Tromsø is cancelled.
In this situation, the affected customer may choose between:
-
a 100% refund of the amount paid to Via di Bella for the affected tour; or
-
a free rescheduling to another available departure.
Via di Bella may request reasonable documentation confirming the cancellation of the port call.
This exception applies to cancellation of the ship's call at Tromsø and does not automatically apply where an individual passenger is late leaving the ship, misses the meeting point or otherwise fails to attend while the ship has called at the port as scheduled.
8. Flight Delays and Flight Cancellations
Customers are responsible for allowing sufficient time between their flight arrival and the scheduled tour departure.
Flight delays, missed connections, baggage delays, airport queues, transportation delays or similar circumstances do not entitle the customer to a refund.
If the flight the customer intended to use to reach Tromsø is officially cancelled, Via di Bella will allow the affected booking to be rescheduled once free of charge to another available departure.
The flight-cancellation exception provides a rescheduling right and does not automatically provide a right to a cash refund.
Via di Bella may request reasonable documentation confirming the flight cancellation.
9. Cancellation by Via di Bella
Via di Bella reserves the right to cancel a tour where reasonably necessary, including because of:
-
unsafe weather conditions;
-
dangerous road conditions;
-
road closures;
-
avalanche risk;
-
mechanical or operational problems;
-
insufficient participant numbers;
-
illness or unexpected staff unavailability;
-
orders or restrictions imposed by authorities; or
-
other circumstances that make the tour impossible or unsafe to operate.
If Via di Bella cancels a tour, the customer may choose between:
-
a 100% refund of the amount paid to Via di Bella for the cancelled service; or
-
free rescheduling to another available departure.
Unless required by mandatory law, Via di Bella is not responsible for consequential expenses arising from the cancellation, such as flights, hotels, rental cars or other independently booked travel arrangements.
10. Minimum Participant Numbers
Some tours require a minimum number of participants in order to operate.
The minimum number may vary depending on the tour, season, vehicle, route and operational circumstances and does not need to be the same for every departure.
If Via di Bella cancels because there are insufficient participants, the customer may choose between:
-
a full refund; or
-
free rescheduling.
Via di Bella may also offer the customer the opportunity to operate the tour as a private tour or alternative service for an additional charge. Acceptance of such an offer is entirely optional.
11. Weather Conditions
Tours in Northern Norway operate in Arctic and rapidly changing weather conditions.
Rain, snow, wind, clouds, fog, low temperatures, reduced visibility or similar weather conditions are normal possibilities and do not, by themselves, entitle the customer to cancel, obtain a refund or receive compensation.
Via di Bella determines whether a tour can be operated safely.
If Via di Bella determines that the conditions are unsafe and cancels the tour, Section 9 applies.
12. Route and Itinerary Changes
Safety takes priority over the advertised itinerary.
Via di Bella may reasonably change:
-
the route;
-
viewing locations;
-
stops;
-
departure or return arrangements;
-
the order of activities;
-
the time spent at individual locations; or
-
the overall itinerary
because of weather, road conditions, road closures, avalanche risk, traffic, accidents, local restrictions, safety concerns or other operational circumstances.
Reasonable itinerary changes that do not fundamentally prevent delivery of the booked service do not by themselves create a right to a refund.
13. Tour Duration
All tour durations stated on the website, booking platforms, advertising materials or booking confirmations are approximate unless expressly stated otherwise.
Tours may finish earlier or later than the estimated duration because of:
-
weather;
-
traffic;
-
road conditions;
-
route changes;
-
guest requirements;
-
safety considerations;
-
natural conditions; or
-
other circumstances encountered during the tour.
Reasonable deviations from the advertised duration do not by themselves entitle the customer to a refund.
14. Northern Lights
The Northern Lights are a natural phenomenon.
Via di Bella cannot and does not guarantee that the Northern Lights will be visible during any particular tour.
Aurora visibility depends on several uncontrollable factors, including solar activity, cloud cover, local weather and atmospheric conditions.
The absence of visible Northern Lights during a tour does not entitle the customer to a refund, compensation or free replacement tour unless such a benefit has been expressly included in the specific product purchased.
15. Wildlife and Natural Phenomena
Via di Bella cannot guarantee sightings of:
-
whales;
-
reindeer;
-
moose;
-
birds;
-
marine animals; or
-
any other wildlife.
Via di Bella also cannot guarantee unobstructed visibility of the midnight sun, mountains, fjords, landscapes or other natural phenomena.
Wildlife and natural conditions are outside Via di Bella's control.
Failure to see a particular animal or natural phenomenon does not entitle the customer to a refund.
16. Participant Fitness and Personal Responsibility
Customers are responsible for ensuring that they are physically capable of participating in the activity they have booked.
Outdoor activities may involve uneven terrain, snow, ice, cold temperatures, wind, water, hiking, getting in and out of vehicles and other conditions associated with outdoor activities in Northern Norway.
Participants must use reasonable care for their own safety and the safety of others.
17. SUP and Water Activities
Participants taking part in stand-up paddleboarding (SUP) or other water-based activities must be able to swim.
Participants must:
-
follow all safety instructions;
-
use required safety equipment;
-
accurately disclose relevant information requested by Via di Bella; and
-
act responsibly on and around the water.
Via di Bella may refuse or terminate participation where it reasonably considers continued participation unsafe.
18. Health Conditions and Pregnancy
Customers must inform Via di Bella before the activity about any relevant:
-
medical condition;
-
injury;
-
physical limitation;
-
mobility issue;
-
pregnancy; or
-
other circumstance
that may materially affect their ability to participate safely.
Customers remain responsible for determining whether an activity is appropriate for them and should obtain professional medical advice where necessary.
Via di Bella may refuse participation where it reasonably considers that participation would create an unacceptable safety risk.
Nothing in this section requires a customer to disclose health information that is unrelated to the safe provision of the booked activity.
19. Children and Child Seats
Parents and guardians are responsible for informing Via di Bella in advance when a child requires a child seat, booster seat or other appropriate restraint system.
The customer must contact Via di Bella before the tour and provide sufficient information for Via di Bella to determine which type of child restraint is required.
Via di Bella may request information such as the child's:
-
age;
-
height; and
-
weight.
Parents and guardians are responsible for ensuring that the information provided is accurate.
If Via di Bella has not been informed in advance and an appropriate legally required child restraint is not available, Via di Bella may be unable to transport the child.
20. Alcohol, Drugs and Unacceptable Behaviour
Via di Bella may refuse participation or remove a participant from a tour if the participant:
-
is seriously intoxicated;
-
is under the influence of illegal drugs;
-
behaves aggressively or threateningly;
-
harasses guides, drivers, other guests or third parties;
-
deliberately damages property;
-
repeatedly disrupts the tour; or
-
creates a safety risk.
A participant removed or refused for these reasons is not entitled to a refund or free rescheduling.
21. Instructions from Guides and Drivers
Participants must follow all reasonable safety instructions given by Via di Bella guides and drivers.
This includes instructions concerning:
-
vehicles;
-
roads;
-
parking areas;
-
weather;
-
wildlife;
-
water;
-
equipment;
-
hiking;
-
meeting times; and
-
dangerous or restricted areas.
Via di Bella may terminate a person's participation without refund if the participant repeatedly or seriously refuses to follow safety instructions.
22. Clothing and Equipment
Customers are responsible for arriving with clothing and footwear reasonably appropriate for the booked activity and expected Arctic conditions unless the product description expressly states that specific clothing or equipment is provided by Via di Bella.
Cold, snow, rain, wind and rapidly changing weather should be expected in Northern Norway.
A customer's failure to bring appropriate personal clothing or footwear does not create a right to a refund.
23. Personal Property and Luggage
Customers remain responsible for their own luggage, mobile phones, cameras, clothing, valuables and other personal property.
Via di Bella is not responsible for items that are lost, forgotten, stolen or damaged except to the extent that Via di Bella is legally responsible for the loss or damage under mandatory law.
Customers should not leave valuable items unattended in vehicles or at tour locations.
If Via di Bella finds lost property, reasonable efforts may be made to return it. Any shipping or delivery costs may be charged to the customer.
24. Photography and Marketing
Via di Bella guides may take photographs or videos during tours.
Images or recordings in which a participant is identifiable will not be used for Via di Bella's advertising, website, social media or other promotional purposes without the participant's prior consent, where consent is legally required.
Consent to marketing use is voluntary and is not a condition of participating in a tour.
Where consent is relied upon as the legal basis for use, the participant may contact Via di Bella regarding withdrawal of consent for future use in accordance with applicable data-protection law.
25. Bookings Made Through Third-Party Platforms
These Terms & Conditions govern the operation of Via di Bella tours and participant conduct regardless of the booking channel, to the extent legally and contractually applicable.
Bookings made through third-party marketplaces or travel agencies such as GetYourGuide, Viator or similar services may additionally be subject to the platform's own contractual terms, payment procedures, refund procedures and customer-service rules.
Via di Bella's Terms & Conditions apply to the greatest extent permitted, but they cannot override mandatory laws or binding third-party platform conditions that legally govern a transaction processed through that platform.
Where a booking is made directly through via-di-bella.com, these Terms & Conditions govern the booking.
26. Personal Information
Via di Bella processes personal information where necessary to:
-
process bookings;
-
communicate with customers;
-
operate tours;
-
meet legal obligations;
-
provide requested services; and
-
protect legitimate operational and safety interests.
Personal data will be processed in accordance with applicable Norwegian and European data-protection legislation and Via di Bella's Privacy Policy.
27. Liability
Via di Bella takes reasonable measures to provide tours safely and professionally.
Outdoor and Arctic activities may nevertheless involve risks that cannot be completely eliminated.
To the fullest extent permitted by law, Via di Bella is not responsible for losses resulting solely from circumstances outside its reasonable control, including weather, natural phenomena, road closures, traffic disruption, wildlife behaviour or actions of third parties.
Via di Bella is not responsible for indirect or consequential travel expenses such as independently booked flights, accommodation or rental vehicles solely because a tour is changed or cancelled, except where liability is required by mandatory law.
Nothing in these Terms & Conditions excludes or limits liability where such exclusion or limitation would be unlawful, including any rights or remedies that cannot be waived under mandatory consumer law.
28. Force Majeure and Events Outside Our Control
Via di Bella may be unable to provide or complete a service because of events outside its reasonable control, including:

extreme weather;
-
natural disasters;
-
avalanches;
-
road closures;
-
accidents;
-
emergencies;
-
government restrictions;
-
strikes;
-
major infrastructure failures; or
-
other extraordinary circumstances.
Where Via di Bella cancels the booked tour entirely, the refund or rescheduling provisions in Section 9 apply.
29. Complaints
Customers who believe that there is a problem with the service should inform the guide or Via di Bella as soon as reasonably possible so that Via di Bella has an opportunity to address the issue.
After the tour, complaints should be submitted in writing to:
The complaint should include the customer's name, booking reference, date of the tour and a description of the issue.
Nothing in this section limits statutory consumer complaint rights.
30. Mandatory Consumer Rights
These Terms & Conditions are intended to regulate the contractual relationship between Via di Bella and its customers but do not remove rights granted to consumers by mandatory applicable law.
If any provision of these Terms & Conditions conflicts with mandatory consumer legislation, the mandatory legislation will prevail to the extent of the conflict.
31. Governing Law
These Terms & Conditions and bookings with Via di Bella AS are governed by Norwegian law.
Any dispute should first be addressed directly between the customer and Via di Bella with the aim of reaching an amicable solution.
If a dispute cannot be resolved, it may be brought before the competent Norwegian courts, subject to any mandatory jurisdiction rights available to consumers under Norwegian or applicable EEA law.
32. Severability
If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law.
33. Changes to These Terms
Via di Bella may update these Terms & Conditions from time to time.
Unless required by law, changes made after a booking has been confirmed will not retroactively alter the material contractual terms applicable to that existing booking.
The version applicable to a booking is normally the version in effect when the booking was completed.
